1. Acceptance of Terms
By using Kavi AI Solutions ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Kavi AI Solutions provides an AI-powered voice receptionist that answers inbound calls for local businesses. The AI agent greets callers, answers questions, books appointments, captures leads, and takes messages. The Service is inbound-only — it does not initiate outbound calls or telemarketing.
Additional features (website, chatbot, analytics, outbound sales) may be available as add-ons under separate terms.
3. AI Disclosure & Limitations
You acknowledge that: The AI voice agent is an artificial intelligence system, not a human. While designed to be natural and helpful, it may occasionally misunderstand, provide inaccurate information, or fail to handle complex situations. The Service is not a substitute for professional human receptionist services in all circumstances.
- The AI agent identifies itself as AI at the start of every call.
- Call recording is announced at the start of every call.
- Emergency calls should be redirected to emergency services — the AI is not trained for crisis response.
- We recommend testing the AI thoroughly before full deployment.
4. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
5. Subscription & Billing
- Plans are billed monthly. Setup fees are one-time and non-refundable after work has begun.
- Payments are due at the start of each billing period.
- Late payments may result in service suspension after a 3-day grace period.
- You may cancel anytime. Upon cancellation, service continues until the end of the paid billing period.
- Monthly fees are non-refundable except as required by law.
6. Client Responsibilities
- Provide accurate business information for AI training (hours, services, pricing, common questions).
- Notify callers that calls may be recorded, as required by applicable state law.
- Maintain a working phone number and internet connection for call forwarding.
- Not use the Service for illegal, fraudulent, or abusive purposes.
- Not use the Service for outbound telemarketing, robocalling, or any activity regulated by the TCPA without separate written agreement.
7. Service Level & Availability
- We aim for 99.9% uptime but do not guarantee uninterrupted service.
- We may perform maintenance with reasonable notice.
- Service quality depends on third-party APIs (ElevenLabs, DeepSeek). We are not liable for outages caused by third-party providers.
- We are not liable for missed calls due to technical issues, network outages, or configuration errors.
8. Limitation of Liability
To the maximum extent permitted by law, Kavi AI Solutions shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, lost revenue, or lost business opportunities arising from use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Kavi AI Solutions from any claims arising from: (a) your use of the Service in violation of these terms, (b) violation of any law or third-party rights, (c) any content you provide, or (d) your failure to comply with call recording and AI disclosure laws.
10. Intellectual Property
The Service, including its software, branding, and AI models, is the property of Kavi AI Solutions. We do not claim ownership of your business data or customer information. The AI agent's voice and personality are trained for your business during setup but remain our intellectual property.
11. Data Privacy
Our handling of your data is governed by our Privacy Policy. Call recordings and transcripts may be used for AI training after anonymization. You may opt out of training use by written request.
12. Termination
We may terminate or suspend your account for violation of these terms with 7 days' notice. We may terminate immediately for illegal activity or actions that threaten the security of our platform. Upon termination, your data will be deleted within 30 days unless retention is required by law.
13. Changes to Terms
We may update these terms at any time. Material changes will be notified via email or through our dashboard. Continued use after 14 days constitutes acceptance.
14. Governing Law
These terms are governed by the laws of Wisconsin, USA. Any disputes shall be resolved in the courts of Wisconsin.
